To resolve a dispute most favorably for the client, an attorney needs to effectively acquire, assess and communicate the relevant factual and legal information.
This requires a thorough investigation of the facts of the case, a cost-effective legal analysis of the client’s position in the litigation, and a willingness to go to trial if we are unable to reach a fair and acceptable settlement before trial.
Communication
The attorney-client relationship works best where there is effective communication.
In our initial contacts, I will identify the critical legal and factual issues of the case, and provide the client with an early evaluation of the dispute, and the likelihood of success.
As the dispute or litigation proceeds, the client’s goals are constantly assessed and reassessed — Have the goals changed? Are they still achievable? How can we best reach those goals?
Clients are updated about their case whenever there are developments in the matter.
I endeavor at all times to effectively and convincingly communicate my client’s “best case” to the adversaries, judge and jury.
Preparation
Depending upon the nature of the case, preparation includes carefully and thoroughly interviewing the client, gathering and reviewing the client’s relevant documents, analysis of the scope of potential e-discovery, interviewing witnesses, and researching the opposing party/ies.
Legal issues are identified at the start of the case, guiding our pre-trial discovery decisions.
I prepare for trial from the moment I am retained. I recognize that although most commercial litigations do not proceed to verdict, my clients’ cases are strengthened because adversaries know from the start that I am prepared to go to trial.
Enforcement of Judgments
If you are a plaintiff, you do not merely want to obtain a judgment. You also want to maximize your chances of collecting on the judgment.
Through my experience in the court system, as well as through the discovery process and comprehensive online research, I aggressively seek and pursue a defendant’s assets to satisfy my client’s judgment.
Where advisable, I also use the services of private investigators who have access to proprietary databases not otherwise available to the general public.
